what is the texas lemon law?

The Texas Lemon Law specifically protects consumers of defective motor vehicles that have warrantable defects that create a serious safety hazard or substantially impair the use or market value of the motor vehicle.

To qualify for the Texas Lemon Law, the vehicle must be purchased or leased from a Texas dealer, be owned/leased by a Texas resident and registered in Texas, or the owner/lessor must be stationed in Texas (if in the Armed Forces) at the time the claim is filed.

A manufacturer must repair the vehicle within a reasonable time or number of attempts. For an especially strong case, the defect must “substantially” impair the vehicle’s use, value, or safety and must be subject to at least two repairs in the first year or 12,000 miles and two additional repairs prior to 2 years from the date of purchase and the expiration of 24,000 miles. If the defect is deemed a “serious” safety hazard, then only one repair is necessary to qualify.

A vehicle can also be deemed a lemon if it is out of service 30 or more calendar days within 2-years or 24,000 miles with at least two repair attempts must be made within the first 12 months or 12,000 miles.

What is the Texas Lemon Law

The Lemon Law specifically protects consumers of defective motor vehicles that have warrantable defects that “substantially” impair your use, value, or safety; and have been subjected to an “unreasonable” number of repair attempts, and that the problem was reported within a specified time period after the original in service date. Each state has a slightly different version of this law.

Are used cars included?

If the vehicle was purchased within the statutory period and had problems, it may still qualify for Lemon Law protection. Or, if the vehicle was purchased with a balance of a manufacturer’s warranty but was outside the Lemon Law period, you may still have a claim under the Magnuson-Moss Warranty Act for damages if it was subjected to repeated problems!
